Effective Date: June 25, 2026These Terms of Use ("Terms") govern your use of the BP FOOD mobile application, website, and related services ("Services"), provided by Heartery ApS ("Heartery", "we", "our", or "us").
By creating an account or using BP FOOD, you agree to these Terms. If you do not agree, please do not use the Services.
1. About BP FOOD
BP FOOD is a digital wellness application designed to help users make informed food choices, plan meals, monitor nutrition, and support healthy lifestyle habits.
The information provided by BP FOOD is intended for general educational and informational purposes only.
2. Not Medical Advice
BP FOOD does not provide medical advice, diagnosis, or treatment.
The app does not replace a physician, dietitian, pharmacist, or other qualified healthcare professional.
Always seek professional medical advice regarding any medical condition, treatment, medication, or dietary change.
Never ignore professional medical advice or delay seeking it because of information provided by BP FOOD.
If you believe you are experiencing a medical emergency, contact your local emergency services immediately.
3. Eligibility
You must be legally permitted to use the Services under the laws of your country.
If you are under the age required to provide valid consent under applicable law, you may use BP FOOD only with the permission of a parent or legal guardian.
4. Your Account
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities that occur under your account.
You agree to provide accurate information and to keep your account information up to date.
5. Acceptable Use
You agree not to:
• use BP FOOD for unlawful purposes
• interfere with the operation or security of the Services
• attempt to gain unauthorized access to our systems
• upload malicious software or harmful content
• copy, reverse engineer, or attempt to extract the application's source code except where permitted by law
• use the Services in a manner that could damage or impair their operation
6. User Content
You retain ownership of the information, photographs, and other content you submit.
By submitting content to BP FOOD, you grant Heartery a limited license to store, process, and use that content solely for providing and improving the Services.
You remain responsible for the content you submit.
7. Artificial Intelligence
Certain features use artificial intelligence technologies, including services provided by OpenAI and Google Gemini.
AI-generated responses, meal plans, nutrition analyses, and recommendations are automatically generated and may occasionally contain inaccuracies or incomplete information.
You should exercise your own judgment and consult a qualified healthcare professional before making significant medical or dietary decisions.
8. Health Data
If you choose to connect Apple Health or Google Health Connect, BP FOOD will access only the data you authorize.
You may revoke these permissions at any time through your device settings.
9. Availability
We aim to provide reliable Services but do not guarantee uninterrupted availability.
We may modify, suspend, update, or discontinue any feature at any time without prior notice.
10. Intellectual Property
BP FOOD, including its software, design, graphics, logos, text, and other content, is owned by Heartery ApS or its licensors and is protected by applicable intellectual property laws.
Except as expressly permitted, you may not copy, distribute, modify, or reproduce any part of the Services.
11. Disclaimer of Warranties
BP FOOD is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Heartery disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
We do not guarantee that the Services will always be error-free, uninterrupted, or suitable for every user's needs.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Heartery ApS shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of BP FOOD.
Our total liability arising from your use of the Services shall not exceed the amount you paid to use BP FOOD during the twelve months preceding the event giving rise to the claim, or EUR 100 if you have not made any payment, whichever is greater.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
13. Termination
You may stop using BP FOOD and delete your account at any time.
We may suspend or terminate access if these Terms are violated or if necessary to protect the security or integrity of the Services.
14. Privacy
Your use of BP FOOD is also governed by our Privacy Policy.
Please read the Privacy Policy carefully to understand how we collect and process your information.
15. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, we will update the Effective Date and may notify users through the app or other appropriate means.
Continued use of BP FOOD after the updated Terms become effective constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of Denmark, without regard to conflict of law principles.
If you are a consumer residing in another country, you may also benefit from any mandatory protections provided by the laws of your country of residence.
